Rental Terms and Conditions

These Rental Terms and Conditions govern the relationship between Vstar Multimedia LLC (“Us” or “We”) and any person that avails the rental services offered by Vstar Multimedia LLC.

1. General Terms and Eligibility

  1. By renting an eligible product from Virgin Megastore, you agree to these Rental Terms and Conditions and these Rental Terms and Conditions will be deemed the contract between us and you. If you do not agree to these Rental Terms and Conditions, then you may not use our rental services. We reserve the right to modify these Rental Terms and Conditions at any time without prior notice. You agree that each visit you make to our website or store shall be subject to the Rental Terms and Conditions as displayed, and your continued use of the rental services now or following the modifications in these Rental Terms and Conditions confirms that you have read, accepted, and agreed to be bound by such modifications.
  2. Rentals are available to customers aged 18 or above. A valid ID and payment method is required.
  3. You must provide accurate information when placing an order. Any false or misleading information may result in refusing an order or cancellation of an existing rental.
  4. We are entitled to accept or refuse any rental order at our own discretion without providing any reason whatsoever.

2. Rental Period and Extensions

  1. The rental period starts when the product is collected in-store or delivered to an address designated by you while placing the order.
  2. The product must be returned on the agreed due date. Late returns may result in additional fees. Early returns may be accepted by us in our sole discretion, but no refunds will be provided to you in case of early returns.
  3. Extension of rental periods may be requested before the due date, but such requests are subject to availability and additional charges.
  4. If you cancel an order after such order has been confirmed by us, then you shall not be entitled to any refund of any amounts paid.

3. Product Condition and Use

  1. All rental products are cleaned, checked, and prepared before being rented out.
  2. You are responsible for inspecting the rented product upon receipt and for immediately reporting any issues. Receiving a product by you is considered an acceptance of the product’s condition and its suitability for the purpose of renting it.
  3. Products must be used as intended. Any misuse, unauthorized repairs, or modifications may result in additional charges or confiscation of the security deposit.

4. Deposit Policy

1. Product Not Returned.
% of Deposit Captured: 100%
- Full deposit is forfeited due to non-compliance with the return obligation.

2. Product Returned Damaged, Not Usable, and Not Repairable.
% of Deposit Captured: Up to 100%
- Assessed based on severity and irreparability.
- Full deposit may be retained.

3. Product Returned with Major Cosmetic Damage (Still Functional & Rentable).
% of Deposit Captured: Up to 50%
- Covers significant aesthetic damage that affects resale or rental value.

4. Product Returned with Minor Cosmetic Damage Beyond Normal Wear and Tear.
% of Deposit Captured: Up to 25%
- Includes scratches, dents, or marks that exceed expected usage.

5. Product Returned with Regular Wear and Tear (Minor Cosmetic Damage).
% of Deposit Captured: 0%
- No deduction — considered acceptable usage.

Additional Terms

Repair Cost Thresholds

If the cost of repairing the returned product exceeds 50% of its current market value, the product will be considered irreparable, and up to 100% of the deposit may be retained to cover the loss.

Wear & Damage Definitions

To ensure transparency and avoid disputes, the following definitions apply:

  • Major Cosmetic Damage:
    Deep scratches, cracks, broken casing, or missing parts that significantly affect the product’s appearance or perceived value, even if functionality remains intact.
  • Minor Cosmetic Damage Beyond Normal Use:
    Noticeable marks, scuffs, or dents that exceed typical wear and tear, such as damage from drops or improper handling.
  • Normal Wear and Tear:
    Light surface marks, small scuffs, or fading that occur through regular, careful use of the product.

5. Deposit Collection and Refund

  1. A deposit is required at the time of product collection in-store or when an online order is placed. We reserve the right not to accept an order or deliver/hand-over a product if the deposit is not paid by you.
  2. Upon returning a product, whether in-store or through the online return process, we shall inspect the product to ensure that there are no defects or missing parts and subsequently decide, in our sole discretion (but acting reasonably), whether to refund the deposit (in whole or in part) or not.
  3. Upon successful completion of the inspection, the refund of the deposit (if approved) will be processed.
  4. While the deposit refund is processed immediately upon approval, the time for the refund to reflect in your account depends on the bank or payment provider. Processing times may vary and is not controlled by us.
  5. Non-Returned Items.

If a product is not returned on the due date, the deposit will not be refunded. We reserve the right to take any legal action to recover any non-returned product.

Condition of Returned Items

You are responsible for the product during the rental period. Accordingly:

  • Normal wear and tear resulting from proper usage of the product may not affect the deposit refund.
  • If a product is returned with damage exceeding normal wear and tear, or missing any of its components, we reserve the right to deduct a portion of the deposit based on the repair or replacement cost.
  • The balance of the deposit, if any, will be refunded to you.

6. Returns and Refunds

You must return rental products following the agreed process and on the agreed return date:

  • If rented online: Use the prepaid return airway bill and contact the designated courier service for pickup.
  • If rented in-store: Return the product to the same store where it was collected.

** Refunds for deposit (if approved) are subject to section 4 of these Rental Terms and Conditions.

7. Damage, Loss, and Liability

  1. You are responsible for the product during the rental period, and you are expected to use the products as per the intended purpose and normal usage of such products.
  2. We are not liable for any injuries, damages, claims or losses to you and to any third party caused by the use or misuse of the rented product, as you are solely responsible for any such injuries, damages, claims or losses as long as the products are under your or the third parties’ custody (i.e. from the time the products are received by you until the time such products are returned and accepted by us).
  3. Limitation of Liability:
  • To the fullest extent permissible by law, we, our affiliates, officers, employees and agents are and should not be held liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages. This includes, but is not limited to, loss of profits, data loss, or business interruption arising from the use, misuse, or inability to use any rented products, even if we have been informed of the potential for such damages.
  • The total liability for any claim related to the Rental Terms and Conditions or the rental of any product are limited to the total amount paid for the rental of the specific product that caused the claim.
  1. You agree to fully indemnify, defend, and hold us, our affiliates, and our respective officers, directors, employees, and agents harmless against any claims, losses, liabilities, damages, expenses, and costs (including legal fees) that arise from your breach of these Rental Terms and Conditions, misuse of the rented product, any third- party claims related to your possession or use of the product, or any violation of applicable laws or third-party rights.

8. Cancellations and Order Modifications

  1. You may cancel an order before delivery or collection. However, cancellation fees may apply and will be determined by us in our sole discretion.
  2. You may request modifications to rental dates before the rental period begins, subject to availability and to our acceptance.

9. Delivery

  1. For online orders, products will be delivered to the address designated by you while placing an order. Products will be delivered within the United Arab Emirates only and no cross-border shipping will be accepted.
  2. You are responsible for ensuring that you are available to receive the delivery. Missed deliveries may result in additional fees.
  3. We are not responsible for delays caused by courier service providers, weather conditions, or other unforeseen circumstances.

10. Ownership and Intellectual Property

  1. All rented products remain the property of Virgin Megastores.
  2. You may not copy, modify, resell, or claim ownership of any rented product.

11. Force Majeure

  1. We are not liable for failure to fulfil rental orders due to events beyond our control, including natural disasters, strikes, pandemics, epidemics, transportation disruptions, or any similar events.

12. Disclaimer

All information relating to the products or our rental services are provided without warranties of any kind, either express or implied. To the maximum extent permitted by law, we disclaim all representations and warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, noninfringement, freedom from computer virus, and implied warranties arising from course of dealing or course of performance.

13. Severability

If any part of these Rental Terms and Conditions deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Rental Terms and Conditions and shall not affect the validity and enforceability of any of the remaining provisions of these Rental Terms and Conditions. No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.

14. Amendments

We may amend these Rental Terms and Conditions at any time in our sole discretion, and the amended Rental Terms and Conditions shall be effective immediately upon posting, subject to applicable laws. It is your responsibility to check the Rental Terms and Conditions regularly. If you do not agree with the amended Rental Terms and Conditions, whether in whole or in part, you must not place any order or avail any of our services immediately.

15. Governing Law and Jurisdiction

These Rental Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates. Disputes arising in connection with these Rental Terms and Conditions (including non-contractual disputes) shall be subject to the exclusive jurisdiction of the courts of Dubai.
